Birth certificates, marriage licenses, and death certificates for New York residents outside of the five boroughs of New York City now have the option to include a non-binary gender marker, thanks to a recent announcement from the New York State Department of Health (NYC maintains its own vital records).

To accommodate those who do not identify with either of the two traditional gender binaries, the X option has been added.

Any citizen or permanent resident of New York State who is at least 17 years old may request a gender change on their birth certificate.

If a person is under 16 years old, the gender on their birth certificate can be changed by a parent or legal guardian. The gender of live birth is automatically recorded as male or female, but parents have the option of requesting a fresh certificate with the correct gender written in.
