Adults Required by Law in New Jersey to Wear Bicycle Helmets

Adults in the state of New Jersey may soon be subject to a helmet law if a new measure is passed.

If this legislation passes, New Jersey would become the only state with a law mandating the use of bicycle helmets for adults. A helmet is required by law only for people under the age of 17 in this state.

New Jersey was the first state to mandate the use of bike helmets for minors.

In 1998, the law was amended to encompass people who were use roller skates, roller blades, and skateboards.

Adults would be required by the proposed legislation to always wear protective headgear when using any type of two-wheeled vehicle with a motor.

While helmets do offer some protection, the owner of a local bike shop told News 12 that they are probably unnecessary for the casual cyclist.

“The majority of the bicycles we sell to grownups will be cruiser models… “They’re not necessarily in traffic,” explains Jay Tintele of Jay’s Cycle Center in Westfield.

“I’m not sure if that’s really required”

By its terms, the ordinance would not apply to people using bike paths or other areas set out specifically for cyclists. Reginal Atkins, a member of the Louisiana Assembly, was a main proponent of the legislation.

A representative for Atkins said in a statement, “While some may claim the helmet rule may be discriminatory, which is a reasonable cause of worry, those claims lacks the statistical data and facts to back it.””

The statement continues, “To protect the lives of New Jersey residents who could be negatively affected, the state has passed a helmet law. Similar to the current situation with the seat belt regulation, the implementation of this law will be left to the discretion of individual municipalities. “This legislation is aimed at ensuring the safety of all neighbourhoods, regardless of income level.”
