California State Bar Pulls Trump Ally John Eastman’s Licence Over 2020 Election Scheme

John Eastman, a lawyer closely associated with former President Donald Trump, was accused by the California State Bar on Thursday of planning to rig President Joe Biden’s election in 2020 and was hit with 11 disciplinary charges.

According to a statement from the State Bar of California, the Office of Chief Trial Counsel George Cardona plans to ask for Eastman’s disbarment.

On January 6, 2021, at a “stop the steal” demonstration outside the White House, Eastman is accused of making misleading remarks regarding alleged election fraud.

The state bar claims that Eastman’s comments “contributed” to inciting a group of Trump supporters to rush the U.S. Capitol and prevent Congress from approving Biden’s electoral triumph.

The legal defense team for Eastman referred to the charges against him as “part of a widespread effort to use the bar discipline process to target attorneys who opposed the current administration in the last Presidential election.”

Dr. John Eastman, disputes ‘every aspect’ of the action that has been filed against him by the State Bar, which is based entirely on his role as counsel to the former President of the United States following the 2020 election,” Eastman’s legal representative, Randall A. Miller, said in a press release.

One of several initiatives to reverse Trump’s defeat to Biden was legally engineered by Eastman. In materials that promoted the dubious legal argument that then-Vice President Mike Pence had the authority to unilaterally refuse to recognize Electoral College votes for Biden from critical swing states, Eastman wrote, she claimed that Pence had the authority.

Pence, who oversaw Congress’ attempts to ratify Biden’s victory on January 6, 2021, declined to support that strategy despite pressure from Trump.

Inquiries for comment from CNBC were not immediately answered by Eastman.

According to the notice of allegations filed against Eastman, his ideas “were unsupported by law, based on false and misleading representations of fact, and meant to maintain Trump’s office.”

To reverse the outcome of the election for the highest position in the land, Eastman reportedly “violated this obligation,” according to Cardona in the news release. The attorney “must be held accountable,” according to Cardona.

The 35-page charging statement claims that Eastman, who has been allowed to practice law in California since 1997, “violated his duty as an attorney” by propagating claims of election fraud that he either knew were false or should have known were false.

A second charge against him is advancing a legal interpretation of Pence’s authority “that no reasonable attorney with knowledge in constitutional or electoral law would have determined that the Vice President was constitutionally permitted to take.”

When the House Select Committee looking into the Capitol Riot presented its findings to the public, Eastman was prominently displayed. Before concluding its inquiry late last year, the committee decided to report Trump for a criminal investigation to the Department of Justice.
