Kevin Spacey Is Found Not Guilty of Violence by The Jury

On Thursday, Kevin Spacey triumphed as a New York jury declared him not guilty of abuse for allegedly picking up actor Anthony Rapp and momentarily lying on top of him in a bed after a party in 1986.

Approximately an hour of deliberation later, the jury came to the conclusion that Rapp had not established that Spacey had “touched a sexual or intimate portion” of Rapp. Formally, the case was dismissed by Judge Lewis Kaplan. When the verdict was announced, the lawyers sitting on either side of Spacey put their hands on his back right away.

Jennifer Keller Subsequently Said as She Was Leaving Court

One of Spacey’s attorneys, Jennifer Keller, subsequently said as she was leaving court, “We are very appreciative to the jury for seeing through these fraudulent charges. When he walked away, Spacey avoided speaking to the media.

Rapp, best known for his part in “Star Trek: Discovery,” claimed that in 1986, when Rapp was 14 years old, Spacey, then 26 years old, invited him to his Manhattan home where he picked Rapp up, laid him down on his bed, grabbed his buttocks, and pressed his groin into Rapp’s body without Rapp’s permission.

Before the trial began, the judge rejected Rapp’s assault claim. Later, after Rapp’s counsel had rested their evidence, the judge rejected his claim of deliberate infliction of mental distress, leaving the jury to decide solely on the battery claim. A reasonable person would consider offensive touching of another person without their consent to be committing battery under New York law.

A significant victory, but Spacey still has additional allegations.

The case presented challenges on the legal front as well because the jury was only allowed to hear the battery claim after the court dismissed the assault and intentional infliction of emotional distress counts. According to Jackson, “the jury clearly did not believe factual allegations made by Rapp, hence not finding him credible.”

The ruling was a “Pyrrhic victory” for Spacey, though, because of the other accusations that “hang over him, including criminal proceedings in the UK,” according to CNN Legal Analyst Paul Callan.

With this case and the one that was previously dismissed in Nantucket, Spacey has now defeated two sex assault allegations against him, according to Callan. “He, though, faces a difficult fight in the UK against more serious criminal allegations and numerous accusers.

Pacey Was Charged with Four Counts of Sexual Assault Against Three Individuals

By Britain’s Crown Prosecuting Service in May, Spacey was charged with four counts of sexual assault against three individuals and one allegation of inciting another person to engage in penetrative sexual behavior without their consent. To the allegations, Spacey has entered a not-guilty plea.

Closing Arguments Made by Lawyers

With reference to Spacey’s 2017 apologies to Rapp when he first came out, Rapp’s attorney Richard Steigman said in his closing remarks that Spacey had changed his testimony at trial to suit his defense.

“Don’t take what I said in real time to heart. At the moment, I’m in legal defense. Now, pay attention to me. I’ve got it sorted out,” Steigman said, ridiculing Spacey’s attempt to persuade the jury that publicists forced him to make the statement he later testified he regrets. In contrast to the unedited testimony provided by his client, Steigman dubbed Spacey’s testimony as being rehearsed.

Steigman added, “When you’re polished and a world-class actor and you’re following the script and someone else’s testimony, you can take that stand. When you’re only going to court, coming out, and presenting the truth about your experience, particularly one this nuanced,

Steigman Rejected the Defense’s Counterargument that Rapp Meant to Expose Spacey as Gay.

“Kevin Spacey’s not being gay is not the story’s main message. He molested him sexually while he was only 14 years old. His experience is all that he is sharing with others; nothing more, nothing less. Where is the proof that he informed any media outlet that Kevin Spacey is gay and that they should run with the news? The Me Too movement was brought up in the closing statement by Keller, Spacey’s attorney, who claimed that when Rapp came forward, he “hitched his wagon” to the movement.

According to Keller, this is not a sport where you are either on the Me Too side or the other side.

“This location is quite unique. In our system, charges must be supported by proof, evidence, and unbiased evidence presented to a fair jury. No matter how divided society may be right now, it has no business being here.

Keller asserted that Rapp drew inspiration for his claims against Spacey from a scene that is remarkably identical to the Broadway production of “Precious Sons,” in which Rapp was appearing in with Ed Harris in 1986, the year of the claimed event.

She stated, “Mr. Rapp has falsely reported assault that never occurred at a party that never took place in a room that did not exist. That is why we are here.”

Spacey’s counsel pleaded with the jury not to err by finding Spacey guilty

In her closing statements, Spacey’s counsel pleaded with the jury not to err by finding Spacey guilty of violence while only giving Rapp one dollar in damages.

You’re in this place to evaluate the evidence. Does it exist? It never happened. One penny is too much for something that never happened, according to Keller.
